Law Enforcement Guidelines

These guidelines are intended for law enforcement and government agencies seeking information about XWave users. They explain the legal process we require and the categories of information that may be available. Users looking to understand our approach can also read our Transparency page and Privacy Policy.

We require valid legal process appropriate to the type of request and the jurisdiction in which it originates. Requests should:

• Be issued under applicable law and served through proper channels.
• Identify the requesting agency and a contact for follow-up.
• Identify the specific account and information sought.
• Be as narrow and specific as possible.

We review each request for legal sufficiency and scope, and we may object to requests that are overbroad, vague, or otherwise improper.

XWave is designed to collect and retain as little information as possible. As a result, there is often very little for us to provide, and we cannot produce data we never collected or no longer retain. Any response is limited to information we actually hold and are legally required to disclose.

In genuine emergencies involving a risk of death or serious physical harm to a person, we may respond to appropriately verified requests on an expedited basis, consistent with applicable law.

Where required by law, we may honor valid requests to preserve information we hold for a limited period pending the service of formal legal process.

Our policy is to notify users of requests for their information before disclosure where we are legally permitted to do so, so they have an opportunity to protect their rights. In some cases, the law prohibits us from giving notice.
