Information for law enforcement and government agencies about requesting user information from XWave, and how we respond to legal process.

1.Overview

These guidelines are intended for law enforcement and government agencies seeking information about XWave users. They explain the legal process we require and the categories of information that may be available. Users looking to understand our approach can also read our Transparency page and Privacy Policy.

3.Information that may be available

XWave is designed to collect and retain as little information as possible. As a result, there is often very little for us to provide, and we cannot produce data we never collected or no longer retain. Any response is limited to information we actually hold and are legally required to disclose.

4.Emergency requests

In genuine emergencies involving a risk of death or serious physical harm to a person, we may respond to appropriately verified requests on an expedited basis, consistent with applicable law.

5.Preservation requests

Where required by law, we may honor valid requests to preserve information we hold for a limited period pending the service of formal legal process.

6.Notice to users

Our policy is to notify users of requests for their information before disclosure where we are legally permitted to do so, so they have an opportunity to protect their rights. In some cases, the law prohibits us from giving notice.
